Customs is your biggest tax return: valuation, origin and duty recovery for importers

For an importer-distributor there is no cross-border side of the business — the border runs through the income statement. Duty and GST are self-assessed on every entry, the value, classification and origin you declare are audited the way CRA audits a T2, and the gap between a defensible customs program and a sloppy one shows up directly in landed cost. Here is how we run customs as a tax discipline rather than a shipping chore.

Customs is self-assessment with a four-year memory

The importer of record — not the broker — answers for every declaration. You assess your own 10-digit HS classification, customs value and origin on each entry, now filed through CBSA's CARM portal as a Commercial Accounting Declaration, with your own financial security posted instead of riding a broker's bond. CBSA can reassess for years afterward, and once you have reason to believe a declaration was wrong, you are obliged to correct it within 90 days — silence converts an error into a penalty case under AMPS.

The tax split matters for planning: the 5 percent GST paid at the border comes back as an input tax credit for a commercial importer, so it is a financing cost. Duty never comes back through the GST system. Every dollar of duty avoided through correct classification and origin work is margin; every dollar of GST is timing.

Valuation: the invoice price is the start, not the answer

Canada values most imports under the transaction value method — the price paid or payable, adjusted. Adjustments are where audits live: assists such as tooling or molds you supplied to the factory, royalties and licence fees paid as a condition of the sale, and proceeds that flow back to the vendor all belong in the declared value. Distributors buying from a related US parent or affiliate carry a second layer: the same intercompany price is examined by CBSA, which cares if it is too low, and by the income tax transfer pricing rules, which care if it is too high. One consistent, documented file has to satisfy both. And where there is no sale to value — consignment stock, transfers without an invoice — the fallback methods apply in strict order, and choosing one casually is itself an error.

USMCA origin is a claim you must be able to prove

Duty-free USMCA entry rides on a certification of origin — no prescribed form, nine required data elements, valid as a blanket for up to 12 months — and on the proof behind it. For goods you did not make, that means current certifications from your suppliers, not a folder of expired ones. CBSA and US customs both verify by questionnaire, and a claim that fails is reversed retroactively: duty back through the entries, plus interest and penalties, kept on file for the full six-year record period. We calendar supplier re-solicitation annually, before renewal season, not after a verification letter. One dependency is easy to miss: the product-specific rules are keyed to tariff classification, so reclassifying a good can silently change whether it still qualifies.

The duty-recovery toolbox

Importers routinely leave recoverable duty on the table. Four mechanisms do most of the work.

The 2025-26 whiplash, and selling into the US

Distribution both ways got rewired in eighteen months. In August 2025 the US eliminated the de minimis exemption for all countries, so every parcel entering the US now clears a formal or informal entry with a 10-digit code — a structural change to DDP pricing and to who acts as importer of record on your US sales. In February 2026 the Supreme Court struck down the IEEPA tariffs and collection stopped; if your business, or your US affiliate, was importer of record on US entries that paid them, those refund positions are worth tracking to the dollar.

Sectoral tariffs remain on both sides and shift with little notice, which is why we treat duty as a budgeted, quarterly-reviewed input to pricing rather than a surprise on the broker invoice. The customs file also feeds the ordinary tax one: entries must tie to landed-cost inventory books, and USD payables need an FX policy CRA will recognize. Common questions.

Our customs broker files everything. Are we still liable for their mistakes?

Yes. The importer of record owns every declaration, and brokers act on the data you give them. An annual review of your classification database and origin files is the cheapest audit insurance an importer can buy.

Can we recover duty on goods we re-export to US customers?

Often, through drawback on Form K32 within four years of importation, though USMCA lesser-of-duty rules cap recovery on US-bound goods. Where the export pattern is predictable, the Duties Relief Program removes the duty upfront instead.

Is the GST we pay at the border a real cost?

For a registered commercial importer it is a cash-flow cost, not a margin cost — the 5 percent comes back as an input tax credit. Duty is the opposite: final, and worth engineering down through classification, origin and recovery claims.
