House flipper tax returns: business income, instalments, and HST without surprises

Flip profits are 100 percent taxable business income in Canada — not capital gains — and the return work follows from that: T2125 or T2 reporting with proper inventory accounting, quarterly instalments sized for lumpy income, GST/HST when a renovation is substantial, and foreign reporting when a flip crosses the border. Flip profit is business income — all of it

Canada taxes flip profits as 100 percent business income, with no capital-gains inclusion rate to soften it. Since January 1, 2023, the flipped-property rule makes that automatic for a Canadian housing unit sold within 365 days, subject to narrow life-event exceptions such as death, disability, separation, a work relocation, or insolvency. Hold longer, or flip US houses, and the same result usually follows anyway from first principles: buy-renovate-sell intent makes the house inventory, not an investment.

That framing drives the mechanics. Sole proprietors report on Form T2125; incorporated flippers file a T2. Each project is inventory: acquisition, renovation, carrying, and selling costs sit with the project until the sale closes, then deduct against that sale — not in the year the invoices were paid. And the principal-residence exemption does not rescue a flip; moving in during the reno does not convert a business venture into a sheltered home sale.

Instalments: the tax bill for a lumpy year

One good flip year puts you into CRA's instalment system: quarterly payments are required once net tax owing exceeds $3,000 in the current year and either of the two prior years. The trap for flippers is that CRA's reminder notices are calibrated to last year's income — after a big year, they demand big instalments in a year when nothing may close.

Underpay against the method you chose and instalment interest accrues, compounding daily, with a penalty on larger shortfalls. We forecast project by project as closings firm up and reset the instalment plan each quarter rather than once a year.

US flips: the credit is a business credit

US tax on a US flip — taxed there as ordinary dealer income — comes back to Canada as a foreign business-income tax credit, and the distinction matters: unlike the non-business credit a landlord uses, unused business credits carry back three years and forward ten. Deal income that lands unevenly across the border still gets credited eventually, provided the returns are sequenced so the US liability is final before the Canadian credit is claimed.

Structure decides which forms carry the story. Flipping through a US entity you control adds a T1134 information return, due ten months after year-end — and a US LLC is a corporation in CRA's eyes, a mismatch that can double-tax flip profits. GST/HST: know when you have become a builder

Gut a house far enough — all or substantially all of the interior removed or replaced — and GST/HST treats you as a builder of new housing. The sale becomes taxable: you charge GST/HST on the price, you claim input tax credits on renovation costs, and your buyer may qualify for a new-housing rebate. A cosmetic flip of a used home stays exempt, with no ITCs on the reno.

Pricing a project without deciding which side of that line it falls on is how a margin vanishes at closing — 13 percent of an Ontario sale price is often the whole profit. Assignment sales, meanwhile, have been taxable since May 2022 regardless of renovation depth. We make the builder call at acquisition, not at listing, so the number is in the budget from day one.

Foreign reporting discipline

For US flips held personally, T1135 turns on facts: real property used exclusively in an active flipping business is excluded from specified foreign property, but a one-off venture may not clear that bar. We document the position either way, because the late-filing penalty runs $25 a day to $2,500 per year even when no tax is owing. Flip through a US corporation instead and the shares come off T1135 and onto T1134, where the penalties for silence are heavier still. The right answer changes whenever the structure changes, so we revisit it at every new deal.

Common questions.

Can I get capital gains treatment if I lived in the flip?

Rarely. A Canadian unit sold within 365 days is deemed business income outside narrow life events, and even beyond a year, buy-renovate-sell intent makes the profit fully taxable — occupancy does not create a principal-residence claim for a business venture.

Do I charge HST when I sell a flip?

Only when the renovation is substantial enough to make you a builder — roughly the whole interior replaced. Then the sale is taxable and you claim input tax credits on costs; a cosmetic flip of a used home sells exempt.

How should I handle instalments after my first big year?

Choose the method deliberately. CRA reminders will mirror the big year; if this year is quieter, the current-year method cuts the payments — but the estimate has to be defensible, or instalment interest applies.
